RESOLUTION NO. 18-108

A RESOLUTION OF THE COMMISSIONERS OF QUEENSTOWN TO

ADOPT THE ATTACHED CRITICAL AREA MAP FOR THE TOWN OF

QUEENSTOWN TO INCORPORATE THE LANDS APPROVED FOR

GROWTH ALLOCATION BY ORDINANCE NO.

17-04 INTO THE

TOWN’S OFFICIAL CRITICAL AREA OVERLAY DISTRICT MAP

WHEREAS, in accordance with Md. Code Ann. Natural Resources Article § 8-1808, the Town ofQueenstown has adopted a Critical Area Program, which is set forth in Article IV, Part III ofthe Queenstown Zoning Ordinance, titled “CA Critical Area Overlay District”; and WHEREAS, in accordance Md. Code Ann. Natural Resources Article § 8- I808(c)(I)(iii)(1), the Town has adopted a Critical Area Overlay District Map designating the

critical area land within the Town ofQueenstown, which is reflected in Article IV, Part III, § 27.D ofthe Queenstown Zoning Ordinance; and WHEREAS, on October 26, 2016, after a duly advertised public hearing, the Queenstown Commissioners adopted Ordinance 16-03 titled “AN ORDINANCE OF THE COMMISSIONERS

OF QUEENSTOWN TO APPROVE AND ADOPT THE PROPOSED CRITICAL AREA MAP

FOR THE TOWN OF QUEENSTOWN PROVIDED BY THE DEPARTMENT OF NATURAL

RESOURCES AND THE CRITICAL AREA COMMISSION, AS THE OFFICIAL CRITICAL

AREA OVERLAY DISTRICT MAP FOR THE TOWN OF QUEENSTOWN”, which was approved on March 1, 2017 by Chairman Charles C. Deegan as a refinement; and WHEREAS, after a duly advertised public hearing, on January 11, 2017, the Commissioners ofQueenstown adopted Ordinance No. 16-04, titled “AN ORDINANCE OF THE

TOWN OF QUEENSTOWN TO APPLY THE GROWTH ALLOCATION FLOATING ZONE

DISTRICT TO RECLASSIFY 59.70 ACRES OF CRITICAL AREA LANDS WITHIN THE

WATERMAN PROPERTY FROM RESOURCE CONSERVATION AREA (RCA) TO

INTENSELY DEVELOPED AREA (IDA), which approved the reclassification of59.70 acres of the Critical Area portion ofthe Waterman Property from Resource Conservation Area (RCA) to Intensely Developed Area (IDA); and WHEREAS, after a duly advertised public hearing, on June 14, 2017, the Queenstown Commissioners adopted Ordinance No. 17-04, titled “AN ORDINANCE OF THE TOWN OF

QUEENSTOWN TO ADOPT SUPPLEMENTAL FINDINGS OF FACT IN CONNECTION

WITH THE APPLICATION OF THE GROWTH ALLOCATION FLOATING ZONE TO THE

WATERMAN PROPERTY AND TO REFLECT THAT THE TOTAL ACREAGE OF THE

WATERMAN PRPOERTY TO BE RECLASSIFIED IS 59.402 ACRES, IN ORDER TO BE

CONSISTENT WITH THE NEWLY ADOPTED QUEENSTOWN CRITICAL AREA MAP;

which was approved by the Critical Area Commission on November 1, 2017; and WHEREAS, the Queenstown Commissioners desire to adopt an updated Official Critical Area Overlay Map to reflect the application ofgrowth allocation and the reclassification of59.402 Resolution 18-108 Resolution to Adopt a New Critical Area Overlay District Map Page 1 of2 acres ofthe Waterman Property from RCA to IDA, consistent with Ordinance 17-04 as approved

by the Critical Area Commission on November 1, 2017.

NOW, THEREFORE, the Commissioners ofQueenstown hereby resolve as follows:

Section 1.

The attached map titled “Official Critical Area Overlay Map”, Queenstown, Maryland, dated August 8, 2018, is hereby APPROVED and ADOPTED to incorporate the reclassification of59.402 acres ofthe Waterman Property from RCA to IDA.

Section 2.

The attached map titled “Official Critical Area Overlay Map” shall be deemed to be the adopted Official Queenstown Critical Area Overlay District Map, as referenced in Article IV, Part III, § 27.D ofthe Queenstown Zoning Ordinance, and shall be incorporated by reference therein.
