PARIilNG OF COMMERCIAL TRUCKS AND TRAILERS FOR MORE

THAN TWO HOURS ON THE STREETS OF THE TOWI\

WHEREAS, the Commissioners of Queenstown are authonzed by the Maryland Code Annotated, Local Government Article, $ 5-202 to pass ordinances that the Town Commissioners deem necessary to protect the health, comfort and convenience of its citizens; and WHEREAS, the Commissioners of Queenstown are authoized by the Maryland Code Annotated, Transportation Article, $ 26-301 to adopt ordinances or regulations that regulate the

parking of vehicles, including regulating the towing of vehicles from publicly owned streets, as well as the issuance of citations for a violation of parking regulations adopted by the municipality;

and WHEREAS, the Commissioners of Queenstown have determined that it is desirable and in the public interest to amend Chapter 3 of the Queenstown Town Code, Section 3.5 to prohibit the parking of commercial trucks and trailers on Town streets for more than two hours.

NOW THEREFORE, the Commissioners of Queenstown hereby ordain as follows:

Section Section 3.5 of the Town Code is hereby amended as follows:

Section 3.5

commercial truck and trailer parking in Town.

A. Parking on Town Streets. It shall be unlawful for trucks or trailers such as those used for the transportation of sand, gravel, cement, gasoline, freight, commercial materials.etc., which in any way can be classified as not being used for passenger service, to park for more than two hours on the streets of the Town during the day or night; this does not prevent trucks or trailers from making legitimate deliveries of goods, wares and

merchandise in the Town as long as the truck or trailer does not impede the regular flow of traffic. Private automobiles and light trucks may park at any place where thire are no signs prohibiting the parking of vehicles provided it is for a reasonable period of time. In no case shall parking be permitted on the sidewalks. Any violation of this section shall constitute a municipal infraction, and shall be punishable by a fine of $50.00 for the first

violation, and a fine of $ 100.00 for each subsequent offense, plus court costs.

Section Unless specifically amended as set forth above, all other provisions of the Queenstown Town Code shall remain unchanged.

Section 3.

If any section, subsection, sentence, clause or phrase of this Ordinance is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. The Town Commissioners of Queenstown hereby declare that they would have passed this Ordinance, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases

be declared unconstitutional.
