Ordinance No. 24-02 amends the Town of Queenstown Zoning Ordinance (Articles II, IV, VI, and VII) to add definitions and zoning rules for "cannabis enterprises." It defines a cannabis enterprise, places cannabis enterprises into the "Other Use Category," and updates the Permissible Uses Table to include them. The ordinance permits cannabis enterprise uses (except on-site consumption establishments) in the HC (Highway Commercial), RC (Regional Commercial), and I (Industrial) districts and in commercial areas of an approved RPC overlay district subject to conditions: the site must be located south of "us JLI," the enterprise must be licensed by the State of Maryland, and dispensaries may not be located within 500 feet of a pre-existing school, licensed childcare center, playground, recreation center, library, or public park (with a Board of Appeals special-exception option for an existing commercial building in the HC district). The ordinance expressly prohibits on-site consumption establishments under Title 26 within the Town limits, preserves all other zoning provisions not amended, and includes a severability clause.
