Town of Queenstown Planning Commission Minutes March 7, 2018 A regularly scheduled meeting of the Queenstown Planning Commission was held Wednesday evening March 7, 2018. Present were Philip Snyder, Chair, Town Planner Peter Johnston, Betty White, Loretta Hohmann and Town Manager Amy Moore. Guests present were Brian Weese of Weese Home Builders, Tom Davis of Davis, Moore, Shearon & Associates, LLC and John A.Graham property owner of 306 Del Rhodes Ave. Queenstown. Accordingly, Phil Snyder brought the meeting to order at 7:00 p.m. The following documents were distributed to all members of the Planning Commission that were in attendance, Agenda, Revised site Plan for the Graham residence 306 Del Rhodes Ave from DMS & Associates, Letter from the Queenstown Bank and Queenstown Volunteer Fire Company, Inc regarding 306 Del Rhodes Ave. Queenstown, Ordinance Sign proposed revision, Article XL Signing and Lightning from Perry Stuttman and a Draft of the Official Zoning Map Queenstown, Maryland from Peter Johnston. OLD BUSINESS 1. 306 Del Rhodes Ave.- Mr. Davis provided documents from: a. The Queenstown Bank documenting that there is no issue with the proposed site plan. b. The Queenstown Volunteer Fire Department stating that the proposed set back boundary of 10 feet to 4.7 feet is sufficient to allow fire crews and hose lines to access the proposed dwelling and bank building for any issues that may arise. c. Revised Site Plan letter from DMS addressing the Planning Commission Comments from the February Planning Commission meeting and addressing the Town Planner comments. d. Mr. John Graham stated he would work with a landscape architect to address the required number of shrubs and trees that are required per the 10% Rule requirement Critical Area Regulations (COMAR 27.01.09.01-2N). e. Motion presented by Mr. Phil Snyder – for the proposal of reducing the 10-foot required barrier to 4.7 feet at 306 Del Rhodes Ave. Queenstown, MD. To satisfy the § requirements of Section 42 of the Queenstown Zoning Ordinance the Planning § Commission must make and the record should reflect the findings outlined in 42.G - thus the reference to this section in the motion. These findings are as follows: a. The plan accomplishes the purposes, objectives and minimum standards and requirements of the overlay district; b. The plan is in accordance with the Queenstown Community Plan; c. The plan is internally and externally compatible and harmonious with existing and planned land uses in the area; and d. Existing or planned public facilities are adequate to service the proposed development. Although there is not a specific requirement in the Zoning Ordinance for insuring plantings when meeting the 10% Rule requirements Critical Area regulations (e.g., COMAR 27.01.09.01-2N) typically require landscaping stock planted be 100 percent guaranteed for at least 2 years after planting is completed. The Planning Commission may make this a condition of plan approval. The motion was voted upon and passed unanimously. 2. Zoning Ordinance – Review current sign regulations- the documentation presented from Mr. Perry Stuttman was reviewed. No action taken at this time. NEW BUSINESS Town Commissioner update provided by Town Manager Amy Moore: 1. A lot of water infiltration into the sewer system. The origin or source of the infiltration has not yet been determined after 3 areas were viewed via a camera in the lines. The Town lines will continue to be investigated. 2. New Planning Commissioners must complete the Maryland State Planning Commissions course. This may be taken on line or in person in Centreville, MD. The course must be completed within 6 months of being name a Commissioner. A copy of the certificate will need to be provided to Town Manager Amy Moore. 3. An existing member of the current Planning commissioners must complete the Open Meetings Act. Since all members were not present, a volunteer will be requested at the April 4, 2018 Planning Commission meeting. 1. Comprehensive Rezoning – Queenstown Zoning Ordinance a. Changes to the text of code will be discussed in a future dated Workshop to address the proposed changes from Town Planner Mr. Peter Johnston. 2. Minutes – The Minutes of the February 7, 2018 were reviewed and approved.
